Welcome to ARTIFACTO. Throughout the site, the terms "we", "us" and "our" refer to ARTIFACTO. ARTIFACTO operates this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. By visiting our site and/or purchasing something from us, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms").

Please read these Terms of Service carefully before accessing or using our website. By accessing or using any part of the site, you agree to be bound by these Terms of Service. If you do not agree to all the terms and conditions of this agreement, then you may not access the website or use any Services.

SECTION 1 - ACCOUNT SECURITY AND ACCURATE DATA

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. To complete a purchase, you must provide accurate, current, and complete shipping, billing, and contact details. You are solely responsible for maintaining the security of your account and for all activities that occur under your credentials.

SECTION 2 - HANDCRAFTED NATURE, 90% MATCH, AND POST-DELIVERY HANDLING (MANUAL SHAKING DAMAGE)

Please note that ARTIFACTO does not keep any ready-made stock or pre-manufactured inventory. Every single bottle, including our predefined national team editions and our custom commissions, is crafted 100% by hand, grain by grain, specifically for you only after your order is placed and confirmed.

Because this is a human art form and not a machine-printed process, no two bottles on Earth will ever be identical. We guarantee a 90% visual and structural match to our professional product photography and your requested custom schematics. The remaining 10% represents the "artisanal fingerprint"—tiny, natural variations in the sand flow and layering. These variations are not manufacturing defects; they are proof of authentic human craftsmanship. Consequently, these products are legally exempt from standard retail return periods, and requests for refunds or returns based on these natural variations will not be accepted.

CRITICAL HANDLING & SHAKING DISCLAIMER: Our store's legal and practical responsibility is strictly limited to delivering the product to your doorstep entirely intact (unbroken glass) and with the sand design structurally correct as ordered. Once the package is delivered and passes our 48-hour inspection window without a reported shipping breakage claim, our responsibility ends completely. ARTIFACTO is absolutely not responsible or liable for any subsequent damage, mixing, blending, or blurring of the sand layers caused by customer handling, dropping, intentional or accidental shaking, or curiosity testing after delivery. Sand is an organic material; if shaken violently post-delivery, the design will alter. Post-delivery handling damage is entirely the customer's responsibility.

SECTION 3 - ORDERS, DESIGN LOCK, AND STRICT 24-HOUR CANCELLATION WINDOW

When you place an order, it represents an offer to purchase. ARTIFACTO reserves the right to accept or decline your order for any reason at our sole discretion. Because all items enter a personalized preparation and manual production line immediately, you can only cancel your order or request changes to your uploaded logos, names, or team options within exactly 24 hours of your purchase. Once 24 hours have passed, the design parameters are locked, raw material processing has begun, and your order cannot be canceled, altered, edited, or refunded under any circumstances.

SECTION 4 - PRICES, BILLING, AND CUSTOMS/DUTIES RESPONSIBILITY

Prices for our products are subject to change without notice. ARTIFACTO covers 100% of the international shipping costs via DHL Express to your destination. However, all local customs duties, import taxes, clearance fees, or VAT are governed entirely by your destination country and are the sole financial responsibility of the buyer.

We have no control over these charges and cannot predict their amount. If a buyer refuses to accept a DHL delivery or refuses to pay their country's local customs/tax fees, the package will be abandoned or destroyed by the shipping company. In this scenario, the buyer completely forfeits their right to any refund or replacement. Any attempts to open a financial dispute or chargeback under this scenario will be countered using this binding agreement.

SECTION 5 - SHIPPING TIMELINES, PEAK SEASONS, FAILED DELIVERIES, AND PORCH PIRACY

All delivery times provided (7-12 business days) are estimates only and are not absolute guarantees. We are not liable for delays caused by shipping carriers, customs processing, or global logistics events outside our direct control.

  • Peak Season & Tournament Delays: During high-volume shipping periods, including holidays and the 2026 World Cup season, carrier transit times may experience temporary extensions. Shipping delays caused by carrier overloads do not entitle the customer to a refund, cancellation, or chargeback.
  • Incorrect Information & Unresponsiveness: The buyer is entirely responsible for providing an accurate shipping address, postal code, and an active phone number. ARTIFACTO is not responsible for failed deliveries caused by incorrect delivery details or the customer failing to respond to DHL contact attempts. If a package is lost, destroyed, or abandoned by DHL due to the customer's lack of response, wrong information, or refusal to pay local customs fees, NO refunds will be issued under any circumstances. Since every item is custom handcrafted to order, if the customer wishes to receive the item after a failed delivery, they must place a completely new order at the full retail price.
  • Delivery Threshold & Package Theft: Once the tracking system of the shipping carrier (DHL Express) marks your package status as "Delivered", our legal, financial, and physical responsibility ends completely. Carrier delivery confirmation serves as final, binding proof of contract fulfillment. ARTIFACTO is not liable or responsible for packages stolen from your doorstep, porch, yard, or mail area after delivery has been completed. The buyer must secure their delivery location or contact local authorities/DHL directly regarding missing delivered parcels.

SECTION 6 - INTELLECTUAL PROPERTY & INDEPENDENT FAN ART DISCLAIMER

All original text, website displays, graphics, photography, and original layout concepts on this site are owned by ARTIFACTO.

Crucial Affiliation Disclaimer: ARTIFACTO is an entirely independent art studio. All sand art creations, including our national team-inspired designs, represent our own unique artistic interpretations and independent fan art impressions. We are not officially affiliated, associated, authorized, licensed, or endorsed by FIFA, the 2026 World Cup, any national football federation, any professional sports club, or any professional athlete. All third-party product names, colors, and references are used solely for descriptive and artistic interpretation purposes.

SECTION 7 - THIRD-PARTY LINKS AND TOOLS

You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties. SECTION 8 - RELATIONSHIP WITH SHOPIFY

ARTIFACTO is hosted and powered by Shopify, which provides us with the online e-commerce platform to offer our products to you. However, any sales and purchases you make are made directly between you and ARTIFACTO. You acknowledge and agree that Shopify is not responsible for any aspect of the transactions or products, and you release Shopify from all claims and liabilities related to your purchases from our store.

SECTION 9 - ERRORS AND INACCURACIES

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

SECTION 10 - PROHIBITED USES

You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to violate any international, federal, or state regulations and laws; (c) to infringe upon or violate our intellectual property rights or the rights of others; (d) to transmit false or misleading information; (e) to upload viruses or malicious code; (f) to scrape or gather data using automated bots or manual extraction tools; or (g) to interfere with the security features of the website. We reserve the right to terminate your use of the Service for violating any prohibited uses.
